What is the General Data Protection Regulation (GDPR)?

The General Data Protection Regulation (GDPR), which came into force on 25 May 2018, applies to companies based in the European Union but also to international companies processing personal data belonging to natural persons residing in the European Union. 

Although many of the principles of the GDPR Regulation are in fact an extension of existing EU data protection rules, the GDPR Regulation has a wider scope and stricter standards, while providing for significant financial penalties. For example, it lays down stricter requirements for obtaining consent for the use of certain types of data and extends the rights of individuals to access and transfer such data. It also provides for significant enforcement powers, enabling supervisors to impose financial penalties that can amount to up to 4% of a company's total annual revenue for certain violations. 

The commitment and preparation of MCiT

Data protection is a key issue for MCiT, which complies with current European Union data protection legislation and the General Data Protection Regulation (GDPR).

Having already begun the necessary procedures to comply with GDPR, we undertake the following commitments: 

  1. Transparency: Our Data Policy will remain the only means of describing the methods we use to process users' personal data. At the same time, however, we will provide consent for our new and existing customers and recipients of updates, in-product alerts and solutions we advertise as well as end-customer training campaigns.
  2. Control: We will continue to provide our customers and recipients of updates with control over how their data is used. In this context, we will always provide the right to be forgotten through the newsletters we send.
  3. Accountability: We are responsible for our practices and have established Privacy Principles that explain our rationale for privacy and data protection. Our legal department has regular meetings with regulators and regulators, as well as with privacy experts, to keep us up to date and make the necessary adjustments where appropriate.

Basic legal bases

Conventional necessity

  • The data processed must be necessary for the execution of the project and be specified in the contract concluded with the individual.

Legal interests

  • An enterprise or other third party must have legitimate interests that are not undermined by the rights or interests of the individual consenting to the processing of his personal data.
  • Data processing must be stopped if there is a complaint.

MCiT as the data controller and as the data processor

Data Controller: The data controller is the one who sets the 'goals' and 'means' for each case of personal data processing.

Data controllers should adopt compliance measures that cover how data are collected, their uses and how long they are retained, and ensure that individuals have the right to access the data held.

Perform data processing: The data processor is the one who processes the personal data on behalf of the data controller. Also, in cases where data processing agents are directly involved, data controllers must bind them to ensure safe and legal data processing.

Although MCiT manages most of its services as a data controller, there are some cases in which it also acts as a data processor in the context of its collaboration with businesses. When MCiT processes data as it performs data processing on your behalf, your business must have its own legal basis on which to process and communicate data to us
